Terms of Use for Hsieh

Article 1: Purpose
The purpose of these Terms of Use is to outline the terms and conditions regarding the use and operation of services on “Hsieh” (“Website”).

Article 2: Definitions
The major terms used herein shall have the following meanings:

  1. Members: Users who have registered with the Website by agreeing to the terms and conditions, providing their personal information, and who have executed the user agreement with the Website to use its services.
  2. User Agreement: The agreement between the Website and a Member regarding the use of the Website.
  3. Member’s ID: A unique combination of characters and numbers granted to each Member for identification and service use.
  4. Password: A combination of characters and numbers selected by a Member to verify their ID and protect their rights and interests.
  5. Operator: The person/entity that manages and operates the Website, providing the services.
  6. Termination: The action taken by Members to end the user agreement.

Article 3: Applicable Rules Beyond Standard Terms of Use
The Operator may separately announce and provide guidance on operational policies as needed. If these Terms of Use and operational policies overlap, the operational policies shall prevail.

Article 4: Execution of User Agreement

  1. The user agreement is established when a person who wishes to use the Website agrees to these Terms of Use and the Operator accepts their application for membership.
  2. Any person who wishes to use services as a Member must indicate their agreement to these Terms of Use by reading and clicking “I agree” during the membership application process.

Article 5: Application for the Use of Services

  1. Any user who wishes to use the Website as a Member must provide all requested information, such as User ID, Password, and nickname.
  2. A Member who registers using false information or another person’s information may not claim any right to the use of the Website and may be subject to punishment under relevant statutes.

Article 6: Guideline on Personal Information Processing
The Website and the Operator do not retain Members’ Passwords among their personal information. Anything related to Members’ Passwords shall be handled per the Guideline on Personal Information Processing. The Operator will make efforts to protect Members’ personal information, including their registered information, in accordance with relevant statutes. However, the Operator shall not be liable for information leaks due to reasons attributable to a Member. If a Member registers and distributes illegal postings, including those that disrupt public order or violate national security, the Operator may access and submit such materials to the related institutions upon request.

Article 7: Operator’s Obligations

  1. The Operator shall address any opinions or complaints raised by Members as soon as possible if deemed just. If swift resolution is difficult, the Operator shall inform Members via announcements, messages, or emails.
  2. In the event of equipment breakdown or loss, the Operator shall promptly request repairs or restoration for continuous and stable service operation. However, in cases of natural disasters or unavoidable reasons, the operation of the Website may be temporarily suspended.

Article 8: Members’ Obligations

  1. Members shall comply with the Terms of Use, regulations established by the Operator, notices, operational policies, and relevant statutes. Members shall not disrupt the Website’s operations or tarnish its reputation.
  2. Members may not assign, give away, or provide as security the right to use services or their contractual status under the user agreement without express consent from the Website.
  3. Members shall carefully manage their IDs and Passwords and may not allow any third party to use them without the Operator’s consent.
  4. Members shall not infringe on the intellectual property rights of the Operator, the Website, or any third party.

Article 9: Service Use Hours

  1. Services are generally available 24 hours a day, 365 days a year unless there is an operational or technical delay. The Website may temporarily suspend services for system checkups, extensions, or replacements, with prior notice provided on the homepage.
  2. The Website may temporarily or permanently suspend services without prior notice in cases such as urgent system issues, force majeure events, or overload of traffic during service use. In such cases, the Website shall notify Members as soon as possible.

Article 10: Termination of Use of Services

  1. If Members wish to terminate the user agreement with the Website, they must apply for termination online. Termination of the Website use is separate from the termination of the user agreement.
  2. Upon termination application, Website-related programs are automatically deleted from the Members’ Management screen, and the Operator may no longer access the applicant’s information.

Article 11: Limitations on Use of Services
The Website may restrict, take legal measures, terminate the user agreement, or suspend services for any Member who commits any of the following acts:

  1. Registering false information upon signing up for membership.
  2. Hindering others from using the Website or stealing others’ information.
  3. Impersonating Website management, staff, or related personnel.
  4. Infringing on the rights of the Website or any third party.
  5. Fraudulently using another Member’s ID.
  6. Collecting or disclosing another Member’s personal information without consent.
  7. Committing acts related to criminal activities.
  8. Violating relevant statutes.

Article 12: Management of Postings

  1. The Operator is responsible for managing and operating postings and materials on the Website. The Operator shall monitor postings and, if necessary, delete or move those that violate these Terms of Use.
  2. If public institutions demand the correction of any posting, the Operator may delete or move such posting without the Member’s prior consent.
  3. Criteria for determining faulty postings include serious insults, violations of public order, promotion of illegal activities, infringement of rights, or association with criminal activities.
  4. The Operator may comply with requests from third parties to suspend postings due to defamation or rights infringement.

Article 13: Custody of Postings
If the Operator suspends the Website’s operation due to unavoidable circumstances, it shall make a prior announcement and ensure that all postings are easily transferred.

Article 14: Copyrights to Postings

  1. Members shall own copyrights to materials posted by them on the Website. The Website may not use such materials commercially without the Member’s consent but may use them for non-commercial purposes.
  2. Members may not use materials posted on the Website for commercial purposes without permission.
  3. The Operator may delete, move, or refuse to register materials or content that violates these Terms of Use.

Article 15: Damages

  1. Members shall bear all civil and criminal liability arising within the Website.
  2. The Website shall not be liable for damages caused by force majeure events, including natural disasters or negligence.

Article 16: Indemnification

  1. The Operator shall not be liable for any damages arising from the use of services, disruption of services, or activities between Members or third parties.
  2. The Operator is not liable for the authenticity, trustworthiness, or accuracy of materials posted by Members.
  3. The Operator shall not be liable for disruptions in services due to reasons attributable to Members or external factors beyond the Operator’s control.
  4. The Operator shall not be liable for damages suffered by Members due to system disruptions or security breaches caused by third parties or force majeure events.
